Is this really new in box??

Hi guys. I just wanted to get your guys' opinion if this motor road and rail James looks new in box.

I am looking into buying it for the great price and just rarity as well. If it is Bnib then I will certainly buy it (if someone doesn't beat me to it) but something is just clicking in my head that it is not Bnib. Just the way James looks in his box and I think I can see some tape at the top of the box and aren't the trains supposed to be wrapped up in plastic bags? Beacause all my plarail trains that are new are all wrapped up in plastic and I don't see the instruction manual at the front of the box under James. You could use this one as a reference because I am almost certain that this is Bnib but I'm not interested at that price. Could someone give me an idea if this is really Bnib?
